Rent increases limited in Queensland

New legislation limits the frequency of rent increases to once a year in Queensland.

The Queensland Government has passed legislation limiting the frequency of rent increases to once a year for all residential tenancy agreements and rooming accommodation agreements. 

This new legislation will increase the minimum period before rent may be increased in a residential tenancy agreement from six months to one year, and will impose a new minimum period of one year before rent may be increased by a provider in a rooming accommodation agreement.  

The new one-year minimum period will apply to all residential tenancy and rooming accommodation agreements in effect after 30 June 2023, regardless of when the agreement commenced. Any agreement terms which are inconsistent with the new legislation will be voided.   

The Property Council has consistently maintained that extensive consultation is needed before implementing policy measures intending to address Queensland’s housing crisis. Investors in residential asset classes are facing challenging market conditions, and require certainty and security in order to provide Queenslanders with much-needed housing supply.   

The Property Council has warned that any legislation reforming rental laws needs to strike the right balance to ensure the burgeoning purpose-built student accommodation and build-to-rent sectors, which unlock residential supply by providing dedicated beds for students and long term renters, are not disincentivised.
