Wollongong Council exhibits draft Section 94A planWollongong Council is currently exhibiting its draft Wollongong Section 94A Development Contribution Plan (2014). The Council revises the Section 94A plan each year to reflect the works program in Council’s Delivery Program, with the current draft reflecting the Delivery Program for 2012-2017 and Capital Budget 2014-2015 endorsed by Council at its June meeting.The draft Plan proposes to expand the list of developments which may be fully or partially exempt from paying a contribution to include “residential care facilities” (ie nursing homes) and “industrial training facilities”.In addition further minor amendments have been made in relation to clarifying aspects and improving the operation of the Plan.The Plan applies to the Wollongong LGA, except Stage 1 and 2 of the West Dapto Release Area, which is subject to its own Section 94A Development Contribution Plan (2011).The purpose of this Plan is to enable Council to require contributions be made towards the provision, extension or augmentation of public amenities and public services that will, or are likely to, be required as a consequence of development. Section 94A is part of the Environmental Planning and Assessment Act and is the principal legislation which enables Councils to levy contributions.The levy applies to all residential, commercial, retail and industrial development applications and complying development certificates. For development with a value of between $100,000 and $200,000 a levy of 0.5 percent applies. To development with a value greater than $200,000 a 1 percent levy applies.
