WA’s commercial tenancies code

The Property Council WA is advocating for a reduction in the limit of $m turnover (for eligible tenants in receipt of the Job Keeper payment) which is not an appropriate definition of a small-to-medium enterprise in Western Australia. We also recommend a ‘carve out’ for small landlords who could not bear the burden imposed by the Code.

As the WA Parliament prepares to consider new regulations for commercial tenancy during the COVID-19 period, it is vital that Government and MP’s hear about the real-world experience of our members in managing their tenancy issues. The Property Council is sharing this information with government.

We are highly conscious of the impact on your business operations of non-payment of rent, including your obligations to meet outgoing expenses, staff salaries and responsibilities to financial institutions. We are working hard to limit the Code to genuine tenants in need and seek land tax and rate relief.
