WA Heritage Laws Under Review
Western Australia’s heritage laws are under review.
The Heritage Bill 2015 (The Green Bill) is open for comment until the 25th of September and aims to clarify the types of places that will be considered for entry on the State register, and the key features that contribute to cultural heritage significance through the definition of place that is consistent with national and international standards.
The Property Council will be looking for the Green Bill to provide improved certainty and predictability for property owners through development referral processes and eliminate interim registration. This will establish a one-step process to assess and recommend the entry on the State Register while reducing cost and time of entering on the register.
The Green Bill proposes to introduce Repair Order to address cases of demolition by neglect by requiring the owner to make the place secure, with the State Administrative Tribunal having the power to review a repair order. The Green Bill proposes to set out eligibility criteria for appointment to the Heritage Council where members have to have ‘demonstrated knowledge of or experience in heritage matter and skills’ or a variety of technical qualifications rather than appointing certain interests or groups.
New features to provide incentives for owners include revaluation at the owner’s request of registered land for land tax purposes. Currently, revaluation is available only for land that is subject to Heritage Agreement.
