Draft Accessible Housing Provisions in the Draft National Construction Code (NCC) 2022
The Property Council has provided a submission to Minister de Brenni regarding the proposed accessible housing provisions in the Draft National Construction Code (NCC) 2022. We are deeply concerned about the negative impact that will be felt by our members and are seeking a three- year transition to minimise its impact on housing supply, regulatory burden and cost to industry and the end consumer.
These proposed provisions in the NCC will hamper the ability of the property and housing industry to deliver the number and type of affordable dwellings to adequately house the much-publicised growing population of Queensland, especially as interstate migration rates continue to soar. In its present form, these proposed provisions also risk putting builders and developers in conflict with many local government planning schemes across the state.
The Property Council has been advocating strongly at a State and National level since these provisions were outlined in the Draft NCC.

Draft Legislation (COVID-19 Emergency Response – Permanency) Amendment Bill 2021
The Property Council recently provided feedback to the Queensland Attorney-General in response to the (COVID-19 Emergency Response – Permanency) Amendment Bill 2021. The Property Council is supportive of most of the proposed draft legislation, including the Small Business Commissioner administrating a dispute resolution process for landlords and tenants. However, we do not support the continuation of restrictions that will prevent landlords pursuing tenants for lease breaches after 31 December 2021.
While it is important to support tenants through the uncertainty of a pandemic, it is equally important that landlords can transact fairly, especially as the ‘COVID’ normal becomes more certain and accepted.
