Submission provided on Vegetation Management Bill
The Property Council has provided a submission on the Vegetation Management and Other Legislation Amendment Bill 2018 (Bill).
In 2016, the previous vegetation management reforms proposed by the Government were defeated in the Legislative Assembly. At that time the Property Council provided an in depth submission on the negative effects that the proposed legislation would have on the property industry.
Unlike the previous Bill, the new legislation does not propose any changes to the Vegetation Offsets Act, attempt to reverse the onus of proof, or remove ‘mistake of fact’ as a legal defence.
There are however a number of concerns that the Property Council has raised in its submission, including how local governments may interpret the amendments and updated mapping through their planning schemes. The industry is concerned with how this might affect future development.
A number of recommendations to mitigate issues arising from the proposed amendments have been outlined in the Property Council’s submission.
