Queensland Planning Policy updates

A number of local and state government planning related decisions impacting the property industry have been released.

Amendment of Planning Regulation 2017 and RPI Regulation 2014

The Planning regulation 2017 (Planning Regulation) and the Regional Planning Interests Regulation 2014 (RPI Regulation) were amended on 20 June 2019 by the Planning Legislation (Fees and Other Matters) Amendment Regulation 2019 (Amendment Regulation) and came into effect as of 1 July 2019.

The Amendment Regulation updates the annual indexation of fees and charges in both the RPI Regulation and the Planning Regulation. It also amends the Planning Regulation by:

  • Clarifying when dwelling houses and dual occupancies may or may not be regulated by a local categorising instrument
  • Giving effect to the most current vision of the State Development Assessment Provisions (SDAP)
  • Facilitating the timely development of certain youth detention centres in Wacol, Brisbane.

Draft transport noise corridor modelling – open for comment

The Department of Transport and Main Roads (TMR) has released a draft transport noise corridors (TNCs) for state-controlled roads and railways for public consultation.

The new draft TNCs now take into account additional factors known to influence the extent of noise impacts such as terrain and buildings. This means the new TNCs more accurately represent noise impacts on residential properties adjacent to state-controlled roads and railways.
