Property Law review releases new issues paper

The independent review of Queensland’s property laws, being undertaken by the Commercial and Property Law Research Centre of the Queensland University of Technology (QUT), continues with the release of another issues paper for public consultation.

QUT are seeking submissions by 22 February 2016 in response to a range of procedural and administrative issues around body corporate governance. 

Despite the property law review being established by the former Government, the Palaszczuk Government has committed to carefully consider the findings and recommendations. While there are still numerous elements of legislation under review, the independent review team has already delivered a number of recommendations for Government consideration.

The Property Council is now primarily concerned with the introduction of an equitable and sensible majority decision for the termination of a strata scheme through the Body Corporate and Community Management Act 1997.

Recently the NSW Parliament passed the Strata Scheme Management Bill and Strata Scheme Development Bill, bringing much needed reforms to antiquated strata laws. The Property Council is engaging with the Government to achieve similar reform in Queensland to cater for the needs of 21st century strata living.
