Property law review procedural issues recommendations
The Property Council has responded to the final recommendations of the Queensland University of Technology Commercial and Property Law Research Centre’s review of procedural issues under the Body Corporate and Community Management Act 1997.
Recommendations seeking to simplify strata laws, ease the regulatory burden of compliance and achieve fairness for all parties involved in body corporate schemes were welcomed by the Property Council. In particular, the Property Council expressed support for Recommendation 7 which would clarify that lot owners who own multiple lots should be counted as a voter for each lot they own for the purposes of establishing quorum.
Recommendations 51, 52, and 53 of the report proposed new obligations on the original owner of a scheme to prepare and/or handover particular documentation. The Property Council highlighted the need for future consultation on what level of detail will be required in these new obligations.
