Missing middle still missing

The implementation of the Medium Density Housing Code has been deferred for 47 Councils across NSW. The deferral was enacted through an amendment to the Exempt and Complying Development Codes SEPP on the 6th of July. The Code was due to be implemented in all areas of NSW from this date.

At this stage, Councils that have received a deferral from the Code will have the deferral in place until July 2019.

Sydney LGAs where the code has been deferred:  Bayside, Blue Mountains, Burwood, Camden, Campbelltown, Canada Bay, Canterbury-Bankstown, Cumberland, Georges River, Hawkesbury, Hills, Hornsby, Hunter’s Hill, Inner West, Lane cove, Mosman, Northern Beaches, Parramatta, Randwick, Ryde, Strathfield, Sutherland, Sydney, Willoughby, Wollondilly, Woollahra  

The Code applies in full to the following Sydney LGAs: Waverley, Ku-ring-gai, North Sydney, Blacktown, Fairfield, Liverpool, and Penrith.

Regional Council areas where the Code has been deferred are: Armidale, Ballina, Bellingen, Byron, Central Coast, Coffs Harbour, Hilltops, Kiama, Mid-Coast, Mid-Western, Moree, Narromine, Shellharbour, Shoalhaven, Snowy Monaro, Tamworth, Tweed, Upper Lachlan, Wingecarribee, Wollongong, Yass

The deferrals are designed to give Councils the time to review their Local Environmental Plans and make recommendations to the NSW Government about where terraces and townhouses should be permitted.

The Property Council will be advocating for the full implementation of the Code in July 2019 and will be working with the NSW Government and Local Councils towards this.
