Housing Legislation Update

Commencement of Manufactured Homes (Residential Parks) Act 2003 (MHRP Act) stage 1 amendments

– Sections of the Housing Legislation (Building Better Futures) Amendment Act 2017 to commence on 31 October
– Amendments include limitations on site rent increases for residential parks
– Update provided on Retirement Villages Act 1999 (RV Act) amendments

The implementation of the Housing Legislation (Building Better Futures) Amendment Act 2017 that includes amendments to the RV Act and MHRP Act is occurring through a series of stages.

Proclamation of the first stage of amendments to the MHRP Act occurred late last week, and they are due to commence on 31 October.  Provisions contained in this first stage include limitations of site rent increases.

The accompanying explanatory notes for the proclamation also provide an update on the status of the RV Act amendments.   It is foreshadowed in the notes that a separate proclamation for Stage 1 of the RV Act amendments is intended to be proclaimed in October 2018 with the provisions to commence on 1 February 2019.  Stage 2 is expected to be proclaimed between April and June 2019 and Stage 3 by 10 November 2019.
