Forms available for property agents

To help industry prepare for the transition to the Property Occupations Act 2014, the new Property Occupations Forms are now available on the Office of Fair Trading website.

On 1 December 2014, the Property Agents and Motor Dealers Act 2000 (PAMDA) will be replaced with new industry specific Acts, including the Property Occupations Act 2014. From this date penalties will apply for not complying with the new legislation.

 

 

Key changes in the necessary forms include:

  • The move to a single appointment form: Property Occupations Form 6 replaces PAMDA forms 20A, 21A, 22A, 24A, 23, 25 and 26.
  • The removal of PAMDA Form 30c: instead the warning statement must be written into the sale contract.
  • The removal of PAMDA Form 32A as a lawyer’s certification for waiving a cooling-off period is no longer require.
  • The move to a single application form for all property occupations – property agent, resident letting agent and property auctioneer.
  • Deregulating the property developer licence category.
  • The transitioning of pastoral house into other licence and registration certificate categories.
