Download new legal advice certifications for village operators
Point Four of the Property Council’s Eight Point Action Plan for Retirement Living is to “Encourage all potential residents to seek independent legal and financial advice before signing a contract”
To assist village operators and sales staff to achieve this, leading retirement living law firm and Retirement Living Council Corporate Legal Partner, Russell Kennedy Lawyers, have created template Certifications for industry to use.
These Certifications have been created for use in all jurisdictions. The documents:
- strongly encourage prospective residents to obtain independent legal and financial advice about their rights and duties under the residence contract and related documents before signing them;
- provide a template Australian Legal Practioner’s Certificate which certifies that the resident received certain documents and understood their rights and duties under the documents; and
- provide a template Resident’s Statement to be completed where the resident declined to obtain independent legal advice.
The template Certifications also come with an instruction page that staff can follow to ensure they are legally binding.
