Queensland Government commences its review into the role of developers

  • Will examine if developers should be included in security of payment measures
  • Scope includes developers’ operational and financial capacity, ethical behaviour, and work practices
  • Review Panel to be chaired by Alison Quinn and will include CBUS CEO Adrian Pozzo

The Queensland Government has commenced its review into the role of developers within the building and construction industry.

Since the review was first proposed in 2020, the Property Council has raised concerns with its scope and intent- particularly given the impact a resultant licensing scheme may have on industry.

The spectre of a review into developers was raised in a hearing of the Parliamentary Transport and Public Works Committee, which was tasked with an inquiry into building industry fairness reforms.

The Review Panel will be chaired by industry stalwart Alison Quinn, who the Property Council recommended to the Minister. The other panel members are:=

  • Adrian Pozzo – CEO CBUS Property
  • Gina Patrick – Director Plus Systems
  • John Payne – Principal Hall Payne Lawyers

The Panel has been tasked with examining a range of issues including the financial and operational capacity of developers, their ethical behaviour, and work practices. Crucially, it will also examine whether developers should be captured by the same security of payment measures that apply to builders and contractors. This is of particular concern to the Property Council.

The Property Council has previously expressed concerns that the review and its subsequent outcomes may increase the cost of development, of particular concern for the residential market at a time when Queensland is in the midst of a housing and rental affordability crisis. If a licensing scheme is introduced Queensland will be the only state where developers are licensed.

Further input will be provided from the Property Council to the Panel via the yet-to-be-established industry reference group.

In the coming weeks, the Property Council will hold a forum on the Review and the potential implications of any recommendations that may arise out of it.
