Community Title Regulations released for comment
Following an extensive industry consultation and drafting process, WA’s long awaited Community Titles Regulations have been released for public comment this morning.
The release of the draft regulations comes after substantial strata reforms that commenced earlier this year in May.
Community Titles will change the way mixed use developments will operate in Western Australia, with multiple tiers to exist that will give different tenants exclusive rights over some common property.
This is seen as a game changer that will provide flexibility to developers and landowners who want to allow to provide innovative and tenant specific access to certain amenities within the development.
The Draft Regulations will be open for comment until Wednesday 9 December, with the final Regulations intended to be operational in the first half of 2021.
Property Council WA has been an active advocate in this space, engaging the Department of Planning, Lands and Heritage, as well as Landgate, through our committees. We have also had input through the Community Titles Act Reference Group.
Member feedback will form the basis of our response to the Draft Regulations. Members are encouraged to contact our advocacy team to have their say.
